As you may be aware the Coronavirus Act 2020 brought in various stays including upon possession claims.
Initially, the stay on all possession proceedings was to 25 June 2020 but was then extended by the Government to 23 August 2020, which many landlords hoped would be the final extension. However, a last minute decision by the Government on 20 August 2020 meant that a request to extend the stay to 20 September 2020 was approved by the Civil Procedure Rule Committee on 21 August 2020.
This therefore means that all possession claims are stayed until 20 September 2020. Whilst this is likely to be a welcome decision for many tenants this will leave many landlords frustrated and potentially facing their own financial issues.
There are also currently changes in place in respect of serving notice upon tenants. If you are a landlord and want to discuss the current legal position then please contact Natasha Guest or Andrew Mawdsley in our Dispute Resolution team.
